§ 7.92.070. License requirements—Adult cabarets and adult theaters.

  • An adult cabaret or an adult theater shall conform to all of the requirements previously set forth in this chapter and shall also conform to the following additional requirements:

    A.

    The application for an adult business license shall be accompanied by a diagram of the premises showing a plan thereof specifying the location of and dimensions of the stage upon which live entertainment will be performed, the location of the entertainers' dressing room or rooms, and the location of the entrances to and exits from the premises which are to be used exclusively by the entertainers and those which are to be used by the patrons, all of which demonstrates compliance with the requirements of this section. The tax collector shall waive the foregoing diagram for renewal applications if the owner adopts the diagram that was previously submitted and certifies that the configuration of the premises has not been altered since that diagram was prepared. No alteration in the configuration of the premises from the diagram submitted with the application for an adult business license may be made without the prior approval of the tax collector, who shall insure that the configuration requirements of this section continue to be met.

    B.

    No person shall perform live entertainment for patrons except upon a stage at least 18 inches above the level of the floor, which is separated by a distance of at least six feet from the nearest area occupied by patrons, and no patron shall be permitted within six feet of the stage while the stage is occupied by an entertainer.

    C.

    The business shall provide separated dressing rooms for entertainers which are exclusively dedicated to the entertainers' use.

    D.

    The business shall provide an entrance to and exit from the premises for entertainers which is separate from the entrance and exit used by patrons.

    E.

    The business shall provide access for entertainers between the stage and the dressing rooms which is completely separated from the patrons. If such separate access is not physically feasible, the business shall provide a minimum three-foot-wide walk aisle for entertainers between the dressing rooms and the stage, with a railing, fence or other barrier separating the patrons and the entertainers, which is capable of, and which actually results in, preventing any physical contact between patrons and entertainers.

    F.

    No entertainer shall have physical contact with any patron, and no patron shall have physical contact with any entertainer while on the premises.

    G.

    Fixed rails at least 30 inches in height shall be maintained establishing the separations between entertainers and patrons.
