§ 7.10.350. Respondent—Effect of failure to appeal.

  • If the respondent fails to file a notice of defense or fails to appear at the hearing, such failure shall constitute an admission of all of the allegations of the accusation. The commission may take action based upon the respondent's implied and express admissions or upon other evidence. The commission or referee also may act without taking evidence if the express or implied admissions of the respondent are sufficient to sustain the action taken.
