§ 7.10.260. Notice of hearing.

  • The commission shall deliver or mail a notice of hearing to all parties at least five days prior to the hearing. The hearing shall not be prior to the expiration of the time within which the respondent is entitled to file a notice of defense. The respondent may file a written waiver of time and request an immediate hearing. The notice to respondent shall be substantially in the following form, but may include other information:

    "You are hereby notified that a hearing will be held before the (Commission or referee as appropriate) at ____, on the _____ day of ________, 19___, at the hour of ______, upon the charges made in the accusation served upon you. You may be present at the hearing, may be, but need not, represented by counsel, and may present any relevant evidence, and will be given full opportunity to cross-examine all witnesses testifying against you. You may request the issuance of subpoenas to compel the attendance of witnesses and the production of books, documents or other things by applying to the Commission."

    The commission shall determine the time and place of hearing.
