§ 5.43.010. Definitions.

The following terms when used herein with initial capital letters, unless the context clearly indicates otherwise, shall have the following respective meanings:

A.

"Participant" means any employee who is a participant in the Plan.

B.

"Plan" means the county of Los Angeles Flexible Benefit Plan set forth in Chapter 5.27 of this Code.

C.

"Tobacco User" means a Participant who uses any form of tobacco within the periods designated in this chapter. For purposes of this chapter, each Participant shall be deemed to be a Tobacco User unless he submits written certification to the contrary. Such certification shall be submitted in accordance with instructions issued by the chief administrative officer.
